Welcome to Suelta. These Terms & Conditions apply to the use of our website, our online store, and every order placed through www.suelta-jewelry.com.
By visiting our website, using our services, or placing an order, you agree to these Terms & Conditions. Please read them carefully before making a purchase.
Article 1 – Definitions
In these Terms & Conditions, the following definitions apply:
Cooling-off period: the period during which the consumer may exercise the right of withdrawal.
Consumer: the natural person who does not act for purposes related to their trade, business, craft, or profession and enters into a distance agreement with the entrepreneur.
Day: calendar day.
Distance agreement: an agreement concluded between the entrepreneur and the consumer within the framework of an organized system for distance selling of products and/or services, whereby one or more techniques for distance communication are used up to and including the conclusion of the agreement.
Durable medium: any tool that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.
Right of withdrawal: the consumer’s right to withdraw from the distance agreement within the cooling-off period.
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance.
Technique for distance communication: any means that can be used to conclude an agreement without the consumer and entrepreneur being in the same physical location at the same time.
Terms & Conditions: these Terms & Conditions of the entrepreneur.

Due to the measures introduced and tightened in 2024 regarding the amendment of the Dutch Turnover Tax Act 1968 and the implementation of the Central Electronic System of Payment Information (CESOP), payment service providers may register certain payment data in the European CESOP system.
Article 3 – Applicability
These Terms & Conditions apply to every offer made by the entrepreneur and to every distance agreement and order concluded between the entrepreneur and the consumer.
Before the distance agreement is concluded, the text of these Terms & Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the agreement is concluded that the Terms & Conditions can be inspected and will be sent to the consumer free of charge upon request.
If the distance agreement is concluded electronically, these Terms & Conditions may be provided electronically in such a way that the consumer can easily store them on a durable medium.
If one or more provisions of these Terms & Conditions are fully or partially void or annulled at any time, the agreement and the remaining provisions will remain in force. The invalid provision will be replaced by a provision that most closely reflects the purpose of the original provision.
Situations not covered by these Terms & Conditions must be assessed in the spirit of these Terms & Conditions.
Article 4 – Access, Account and Website Use
By using our website and services, you confirm that you are legally capable of entering into an agreement or that you have permission from a parent or legal guardian where required.
When placing an order, you may be asked to provide information such as your name, email address, billing address, shipping address, and payment details. You confirm that all information provided is correct, current, and complete.
You are responsible for keeping any account details secure and for all activity that takes place under your account.
Article 5 – The Offer
If an offer has a limited validity period or is subject to specific conditions, this will be clearly stated in the offer.
The offer contains a full and accurate description of the products and/or services offered. The description is detailed enough to allow the consumer to properly assess the offer.
We make every effort to display our products as accurately as possible. However, colors, dimensions, and product appearance may vary slightly depending on your screen, device settings, and production differences.
Obvious mistakes or errors in the offer, including pricing errors or typographical mistakes, do not bind the entrepreneur.
All product images, specifications, and details are indicative and cannot give rise to compensation or cancellation of the agreement, unless required by law.
We reserve the right to change product descriptions, prices, promotions, and availability at any time without prior notice.
Article 6 – The Agreement
The agreement is concluded when the consumer accepts the offer and meets the conditions attached to that offer, subject to the provisions of these Terms & Conditions.
If the consumer accepts the offer electronically, the entrepreneur will confirm receipt of the acceptance electronically as soon as possible.
The entrepreneur will take appropriate technical and organizational measures to secure electronic data transfer and provide a safe online shopping environment.
The entrepreneur may, within legal limits, investigate whether the consumer can meet their payment obligations and may refuse an order or attach special conditions to the execution of the order if there are justified reasons to do so.
Every agreement is subject to sufficient product availability. If a product is unavailable after an order has been placed, the consumer will be informed as soon as possible.
Article 7 – Orders and Cancellation
When you place an order, you make an offer to purchase the selected product(s). Suelta reserves the right to accept or refuse an order for justified reasons, including suspected fraud, incorrect pricing, or product unavailability.
Due to our fast processing times, orders cannot always be cancelled once they have been processed. If you wish to request a cancellation, please contact us immediately at info@suelta-jewelry.com. We will do our best to accommodate your request, but cancellation cannot be guaranteed once processing has started.
If your order has already been shipped, you may use the standard return process after receiving the order.
Article 8 – Right of Withdrawal
When purchasing products, the consumer has the right to withdraw from the agreement without giving any reason within 30 days. This cooling-off period starts on the day after the consumer, or a representative designated by the consumer, receives the product.
During the cooling-off period, the consumer must handle the product and packaging with care. The product may only be unpacked or used to the extent necessary to determine whether the consumer wishes to keep it.
If the consumer exercises the right of withdrawal, the product must be returned with all supplied accessories and, where reasonably possible, in its original condition and packaging.
The consumer must notify Suelta within 30 days of receiving the product if they wish to exercise the right of withdrawal. This notification must be made in writing by email.
After notifying Suelta of the withdrawal, the consumer must return the product within 14 days. The consumer must be able to prove that the product was returned on time, for example by providing proof of shipment.

If the consumer does not notify Suelta within the stated period or does not return the product on time, the sale becomes final.
Article 9 – Costs in Case of Withdrawal
If the consumer exercises the right of withdrawal, the return shipping costs are the responsibility of the consumer, unless stated otherwise.
If the consumer has paid an amount, Suelta will refund this amount as soon as possible, but no later than 14 days after receiving the returned product or valid proof of return shipment.
Refunds will be processed to the original payment method, unless otherwise agreed.
Article 10 – Exclusion of the Right of Withdrawal
The entrepreneur may exclude the right of withdrawal for certain products, but only if this has been clearly stated before the agreement was concluded.

Article 11 – Prices and Billing
All prices shown on the website are subject to change without prior notice.
The price charged for a product is the price shown at the time the order is placed and confirmed in the order confirmation email.
Unless explicitly stated otherwise, displayed prices do not include import duties, customs fees, or local taxes that may apply outside the country of dispatch.
Special customs clearance costs, import duties, and/or import VAT are not included in the product price and are the responsibility of the customer, unless explicitly stated otherwise at checkout.
All prices are subject to printing, typing, or system errors. Suelta is not obligated to deliver a product at an incorrect price if the price is clearly the result of an error.
The consumer is responsible for providing accurate and complete payment and billing information.
Article 12 – Payment
Unless otherwise agreed, the amounts owed by the consumer must be paid immediately during the checkout process.
The consumer has a duty to immediately report any inaccuracies in provided or stated payment details to the entrepreneur.
In the event of non-payment, the entrepreneur has the right, subject to legal limitations, to charge reasonable costs that were communicated to the consumer in advance.
Article 13 – Shipping and Delivery
Suelta will take the greatest possible care when receiving and processing orders.
The delivery address is the address provided by the consumer during checkout.
Orders are typically processed within 1–2 business days. Estimated delivery times depend on the destination and are stated in our Shipping Policy.
Delivery times are estimates and are not guaranteed. Delays may occur due to customs, carrier delays, public holidays, weather conditions, peak periods, or other circumstances outside our control.
If delivery is delayed or if an order cannot be fulfilled, the consumer will be informed as soon as possible.
If delivery of an ordered product proves impossible, Suelta may offer a replacement product. The consumer will be clearly informed if a replacement product is supplied.
The risk of damage and/or loss of products remains with the entrepreneur until the moment of delivery to the consumer or a representative designated by the consumer, unless explicitly agreed otherwise.
Article 14 – Shipping Address Accuracy
The consumer is responsible for providing a correct and complete shipping address.
Suelta is not responsible for orders delivered to an incorrect or incomplete address provided by the customer.
Once an order has been dispatched and is marked as in transit, we may no longer be able to modify or redirect the delivery address.
If a package is returned due to an incorrect, incomplete, or unclaimed address, or due to refusal of delivery, additional reshipment costs may apply.
Article 15 – Lost, Stolen or Damaged Packages
If tracking shows that an order has been delivered but the consumer has not received it, the consumer should first check around the delivery location, with neighbors, or with the building’s front desk or mailroom.
If the package is still missing, the consumer should contact the carrier and then contact Suelta at info@suelta-jewelry.com within 7 days of the marked delivery date.
If an order arrives visibly damaged, the consumer must document the damage immediately with clear photos or an unboxing video and contact Suelta within 7 days of delivery.
Without photo or video evidence, we may be unable to process a damage claim.
Article 16 – Conformity and Warranty
The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of reliability and usability, and the legal provisions and government regulations applicable at the time the agreement was concluded.
Any warranty provided by the entrepreneur, manufacturer, or importer does not affect the consumer’s statutory rights.
Defects or incorrectly delivered products must be reported to Suelta in writing within 30 days after delivery. Returned products must, where reasonably possible, be sent back in their original packaging and in new condition.

Article 17 – Intellectual Property and Brand Protection
All content published on or made available through the website, including but not limited to product photos, text, graphics, logos, brand names, jewelry designs, campaign imagery, product descriptions, marketing copy, videos, icons, and other visual or written material, is the intellectual property of Suelta or its licensors.
The consumer may use the website and its content only for personal, non-commercial purposes.
It is not permitted to copy, reproduce, distribute, modify, publish, download, store, sell, or use any material from the website for commercial purposes without prior written permission from Suelta.
Unauthorized use of Suelta’s content, branding, images, product descriptions, or designs may result in takedown requests, platform reports, or legal action where applicable.
Article 18 – Third-Party Tools and Links
The website may contain links to third-party websites, tools, or services. Suelta is not responsible for the content, accuracy, policies, or practices of third-party websites or services.
The use of third-party tools or links is entirely at the consumer’s own risk. Complaints or questions regarding third-party products or services should be directed to the relevant third party.
Article 19 – Relationship with Shopify
Suelta’s online store may be powered by Shopify, which enables us to provide the website and related services. However, all purchases made through our store are made directly with Suelta.
Shopify is not responsible for any sales agreement between the consumer and Suelta, including any damage, loss, or issue resulting from purchased products or services.
Article 20 – Privacy
All personal information collected through the website and our services is handled in accordance with our Privacy Policy.
By using our website or placing an order, the consumer acknowledges that they have read and understood our Privacy Policy.
Article 21 – Reviews, Feedback and User Content
If the consumer submits reviews, photos, feedback, suggestions, or other content to Suelta, the consumer grants Suelta the right to use, reproduce, publish, distribute, and display this content for business and marketing purposes, unless explicitly agreed otherwise.
The consumer guarantees that any submitted content does not violate the rights of third parties, including copyright, trademark, privacy, or personality rights.
Suelta may remove or edit submitted content that is unlawful, offensive, misleading, inappropriate, or violates these Terms & Conditions.
Article 22 – Errors, Inaccuracies and Omissions
Occasionally, information on the website may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability.
Suelta reserves the right to correct any errors, inaccuracies, or omissions and to change, update, or cancel orders if any information is inaccurate at any time, including after an order has been placed.
Article 23 – Prohibited Uses
The website and services may only be used for lawful purposes. It is prohibited to use the website:

Article 24 – Duration Transactions, Termination and Extension
If an agreement is entered into for an indefinite period and concerns the regular delivery of products or services, the consumer may terminate the agreement at any time with due observance of the agreed termination rules and a notice period of no more than one month.
If an agreement is entered into for a fixed period and concerns the regular delivery of products or services, the consumer may terminate the agreement at the end of the fixed period with due observance of the agreed termination rules and a notice period of no more than one month.
An agreement for a fixed period may not be automatically renewed for a fixed period unless legally permitted.
Article 25 – Complaints Procedure
Complaints about the performance of the agreement must be submitted to Suelta within 7 days after the consumer has discovered the issue. The complaint must be described fully and clearly.
Complaints submitted to Suelta will be answered within 30 days from the date of receipt. If a complaint requires a longer processing time, Suelta will send a confirmation of receipt within 14 days and provide an indication of when the consumer can expect a more detailed response.
If a complaint cannot be resolved by mutual agreement, a dispute may arise that is subject to the dispute settlement provisions.
A complaint does not suspend the consumer’s obligations, unless Suelta confirms otherwise in writing.
If a complaint is found to be justified, Suelta may choose to replace, repair, or refund the product where applicable.
Article 26 – Disclaimer of Warranties
The information on the website is provided for general information purposes. Suelta does its best to keep the information accurate and up to date, but does not guarantee that all information is complete, accurate, or error-free at all times.
Except where required by law, the website and services are provided on an “as is” and “as available” basis.
Suelta does not guarantee that the website will always be available, uninterrupted, secure, or free from errors.
Article 27 – Limitation of Liability
To the fullest extent permitted by law, Suelta is not liable for indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, loss of revenue, loss of data, or replacement costs arising from the use of the website, services, or products.
Nothing in these Terms & Conditions limits the statutory rights of the consumer where such rights cannot legally be excluded or limited.
Article 28 – Severability
If any provision of these Terms & Conditions is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the unenforceable part will be considered severed from these Terms & Conditions.
This does not affect the validity and enforceability of the remaining provisions.
Article 29 – Governing Law and Disputes
Agreements between the entrepreneur and the consumer to which these Terms & Conditions apply are governed exclusively by Dutch law, even if the consumer lives abroad.
Disputes will preferably be resolved by mutual agreement first. If this is not possible, the dispute may be submitted to the competent court under Dutch law, unless mandatory consumer protection laws provide otherwise.
Article 30 – Changes to These Terms & Conditions
Suelta reserves the right to update, change, or replace any part of these Terms & Conditions by posting updates on the website.
It is the consumer’s responsibility to check this page periodically for changes. Continued use of the website after changes have been posted means that the consumer accepts those changes.
